Public Defender Mary Jo Earle

Conflict of interest

  • Refusal to Subpoena Witnesses and Conflict Suppression: Public defender Mary Jo Earle explicitly refused to subpoena the witnesses requested by Babak Taherzadeh—including the complaining witness Judge Birmingham, District Attorney Creuzot, and the District Clerk—under the stated rationale that she as counsel decided their testimony was not relevant, persuasive, or helpful. This refusal occurred despite Texas Ethics Commission campaign records showing that Earle had previously made a financial political contribution to Judge Brandon Birmingham’s judicial campaign on December 5, 2014, creating an undisclosed structural conflict of interest.

  • Denial of Removal: Richard Beacom (sitting without  assignment) formally denied Mary Jo Earle's motion to withdraw as attorney of record and refused any implied request for a hearing on the matter, locking Taherzadeh into representation by an attorney who refused to investigate or present his defense witnesses.
